Question:

USA visitor returning home with newborn (usa citizen), what are the procedures?

i am a visitor to the usa and i had my child there (now a us citizen), now i am return to my country with my child, will i need to get a dual citizenship for my child and/or return frequently to the usa with my child? i already have my child's usa passport and ssn. what else should i be aware of? thanks in advance for your replies.

  1. Well, Amanda, I certainly hope your birthing vacation to the US was pleasant, and that you remembered to pay all of your own medical bills.

    Based on the information provided, all anyone can really say is that your child is an American citizen.  You need do nothing more to secure your child's US citizenship - even if your child never returns to the US again, the citizenship status will not change.

    As far as any other citizenship for your child, that depends on your citizenship, and the laws related to the country to which you are returning.  

    And for the record, in an effort to dispel a longstanding myth regarding giving birth at a US foreign mission:  There are certain protections provided to countries at their foreign missions (embassies, consulates and diplomatic offices), but national sovereignty abroad does not extend to the point of giving US citizenship to anyone born at a US diplomatic post - jus soli does not apply.

    if you had mentionned the country were you returned ? he might have dual citizenship ? some countries do not allow it ,

    not many refuse it ,some  ......

  3. unfortunately you are not mentioning what your home country is. it seems that you have established the fact that your child is a citizen by obtaining a passport, so that is a good thing. as to dual citizenship - it might not be available, hence the question of your country. but it might not be necessary at all since most countries will establish residency for your child without any problem. make sure that you have all documents in order, birth certificate with an apostille attached is important.

  4. Your child has dual citizenship already. Jus soli (by soil or by being born in that land) in america and jus sanguinis (by parentage, right of blood) by you. You can get him a passport of your country anytime he needs to. But not required.

    Not a lot of people know this but if you give birth in the US Embassy in your country, your child is a US citizen too. That is because the embassy is considered US soil.**
