Question:

USCIS cannot answer this question??

my soon to be husband is a cuban citizen with permission and a work visa to be in Mexico. Unfortunately his visa term is coming to an end, and he wants to marry me (we're expecting), we've been together for quite sometime, he wants to return to cuba to see his 84 y/o grandmother 1 last time before he enters the US----IF I FILE a I-129F form a fiance visa form---how will he get out of Cuba...will he even be able to leave? I know Cuba does not allow air travel to the United States---would they allow him to enter mexico??? please help---USCIS cannot answer this question---and the State department Visa section always has me on hold for more than 30 minutes and then bounces me back to the main menu and then hangs up?? can any one help?

  1. You say your Cuban fiance is currently in Mexico (presumably from Cuba) but then you ask if "they" would allow him to enter Mexico?  Who, the Cuban authorities, or the Mexican authorities?  Regardless, apparently, if he is there now and entered legally.  Certainly the US authorities have no say in whether a Cuban national enters Mexico.

    And are you saying USCIS refused to answer your questions?  And which visa section have you been trying to call?

  2. This is complicated.  You should definitely retain a good immigration attorney.  It will be well worth it.

  3. First things first. Have the work visa for Mexico extended. That way he could visit his grandma in Cuba and go back to Mexico, then wait for your K-1 petition to come through. Yes, Mexico will be his address for the K-1 petition. You just have to look at it from a different perspective. Just a note...why did it take him to realize that he wanted to marry you now that his work visa is coming to an end?**
