Question:

USCIS letter/notice re requirement on educational background and/or experience?

We (my co-worker) recently received our notice for fingerprinting. Just a day after, we received another notice, this time from USCIS. The way we understood the content, they are questioning the petitioners requirement of 2 years college for the positions we have applied (1) Dental Office Biller and (2) Dental Assistant.

It says in the letter 'The petitioner has not established that the position requires at least 2 years of specialized training or experience....'

How do we answer this?

  1. Difficult:

    U.S. Department of Labor States:

    Most programs take 1 year or less to complete and lead to a certificate or diploma.


  2. They are referring to the requirement that the employer certify both the education and experience required for the job and that they can't find a qualified citizen or resident to fill the job.

    We don't have a shortage in the positions you have applied for so it may be related to that.
