Uncle locked up for a crime he didn't commit

my uncle has been put in jail for 12 years now for a crime he did not comment, there was no evidence leading to him, and he is still not charge with anything. he has a solid alibi, yes no new evidence is found for the crime., but for what. he didn't commit one. so please let me know what i can do, to help him get out? and we don't have the kind of money. the victims family even said it wasn't him, please help me, no one well help re look at his case.

  1.   No one can remain in jail for that period of time without being charged with a crime and convicted.

    If a lawyer cannot help him with proving his innocence..then I would suggest a research on lawyers/ groups who work on these kinds of cases online..to released innocent people..


  2. If your uncle is locked up for 12 years then he must have entered a plea bargain where he plead guilty for a lesser crime than originally charged. What he needs to file is a habeas corpus. Go to http://www.lectlaw.com/def/h001.htm to read about them. I work at a prison and many prisoners file these themselves so someone in your family might be able to help your uncle file one. The only cost will be the filing fee at the courthouse in the city where he is imprisoned. Good luck.

    this is what these people do.  They have the experience to sift through if there WAS or is enough evidence to overturn a conviction, or if there is evidence concerning someone else.

    I agree... he has to be CONVICTED, if he has been in jail for 12 yrs.  

  4. I think it is 72 hours they can lock up a person and if cannot find a charge they must be release. However several people are in prison because they commit the worse crime and that is to have no money, no help and no justice.

  6. There is no way he can be in jail for 12 years without being charged and CONVICTED. People aren't jailed for that long without a conviction.

    We are not a third world country.
