  1. A public trial means that the trial cannot be conduct in secret; the press & other interested citizens cannot be barred from attendance at the proceedings.

    I have no idea where you source a claim for an "impartial" jury."  Each of each brings with us certain biases; a truly "impartial" jury is a theoretical impossibility.

    What is assured is a "jury of your peers."  And, many defense attorneys have found ample reasons for argument on this clause alone.

    Recently, Attorney Fieger of Southfield, Michigan, argued that not enough non-causcasian jurors were seated in judgment of him in his trial for violation of campaign election laws.

    By the way, Mr. Fieger is caucasian.

    Also, here in Michigan, the jury pools are selected from information provided by drivers' license renewal applicants.  Does that mean that the handicapped or impoverished non-drivers are ineligible to be on a jury of "your peers.?"  This is yet another argument to be heard as time comes by a higher court.
