Under what circumstances do the police...?

under what circumstances do the police have the right to order a blood test for the person pulled over in a traffic stop? i know if you are in a serious accident and injured a blood test will be taken to check for drugs, but do the police have the right to take you in to the hospital for a blood test under any other circumstances? for example if the office is having trouble convicting the suspects for drug use, does he have the right to order a blood test?

  1. I'm in california we have the right to do so  cause some times the driver is not real drunk but as police officer you know if he or she over  the limit or not,but that's wast of time 50 % the officer is right & the other 50% he is wrong  


  2. Even without a serious accident ... or even a minor one, the police can require a blood test for drugs if you fail a sobriety test but pass the breathalyzer!

    If you refuse the test ... your license to drive will be suspended for a while, anywhere from 6 months to 1 year depending on the state.

    When you got your license you agreed to allow the authorities to perform certain tests whenever they believe they need to.  Refuse the test, license suspended.  Fail the test, license suspended or revoked.  If they can prove drug use ... jail or probation in your future.

  3. Can he seek a warrant to get a drug test?  Yes.    I'm not sure if thats the question you are asking.  'any other circumstances' is a pretty long list.

  4. go through cort and get a court order if you are a cop and get a blood test order or a probul cause  

  5. Any time they feel that the person is under the influence of something. Yes your office can order mandatory blood drug testing.
