Underage DUI -- 0.04 BAC?

I contacted an attorney and go meet with him tomorrow. I wanted to get some public opinion on what will go down in court. I live in the state of New Jersey, I am a 20 year old male. I actually turn 21 in about three months. When I got pulled over, for a taillight being out, the officer asked me to step out of the vehicle to do the feild tests, in which I completed without a problem. I know that NJ has a zero tolerance law for people under the age of 21 who get caught drinking and driving. What do you think will happen when I go to court. Do you think that the BAC reading will/can be reduced. What are the chances of being charged with a full fledged DUI rather then "operating a mv with a bac of 0.01 to 0.07, underage"? Let me know what you think, thanks for your help!

  1. With a 0.04 BAC, they will almost certainly stick with the Zero Tolerance charge.  It's much less of a headache to prove with a BAC that low.

    You will almost definately get a fine, some alcohol classes, a suspension, and probation.


  2. If they charged you origonally with Uderage DUI, with that BAC, I'm sure that's what they will stick with. Zero tolerance is just that, and a BAC is proof positive for a judge. You'll probably get a drivers license probation and a fine. Maybe a class if they have that in your state.  

  3. Hello snjguy87,  Under the age DWI is a tuff charge to bet my friend.  If you have never been charged before for this it's possible the judge will have mercy. As you stated, have a very good attonery. I have seen in the past were the judge gave some subjects time but there were other factors to the case, like an accident and victims were injured. Just be sure to wear dress shirt and tie to court. Your personal appearence will make some difference to the judge. Always using  " Your Honor " to answer any question or to gave any statement.  Good Luck !
