Underage DUI: What's Next?

Last week I went through a checkpoint, they smelled alcohol on my breath, breathalyzed me, I blew a .036, and cooperated completely as they impounded my car, took my license, and wrote a citation only to have to void it out because they realized I didn't have a high enough BAC, and did nothing else wrong. They said I could go but I was in a bad neighborhood so I asked for a ride, they refused so I was off on my way walking.

My license is suspended for a year under the zero tolerance law in California. My registration was due so I registered the car non op and cancelled my insurance, so I was on public transportation even though I had my license for like 29 more days.

They very next day I also called to schedule a hearing over the phone with the department of driving safety or whatever it's called, even though I know how pointless it is at this point, and I requested to have the evidence sent to me, and they said they would.

My question: What can I expect from here? My "hearing" is in a month but I haven't heard anything else since then. I know this is considered a DUI, but what exactly will that mean in the coming days? Court date? Community service? DUI classes? Jail time? I am just expecting fines but how much will it be?

I'm looking for hopefully police officers or judges or someone like that because I am hearing different things from people I know, people online who have had similar experiences, and from the attorney I talked to on the phone, they all conflict with each other.

  1. Not sure what state you are from but here's how we roll in Cali.  You'll need a lawyer to fight a charge for Vehicle Code 23136 - unlawful for persons under 21 years of age to drive with a BAC of .01 or more.  Hopefully you can get it reduced to a Wet Reckless.

    Drivers under 18 years of age that are convicted of DUI will lose their license for a year OR until their 18th birthday, whichever is greater.

    Additionally, a judge may choose to confiscate an underage driver's vehicle. In all cases, the driver will have to pay fines of several thousand dollars, attend driving safety and alcohol/drug abuse classes, will have to submit proof of financial responsibility in order to have their license restored after suspension, and will suffer numerous social and career-related consequences.

    All underage DUI convictions will lead to the suspension of the driver's license for one year; subsequent convictions will lead to more severe penalties. Likewise, individuals choosing not to submit to chemical testing will automatically lose their license for a year as well.

Yes well first thing you do is get an attorney... save money and buy one because public defenders work for "the man".  If this is your first charge then you will probably just lose your license, have drug/alcohol classes, community service, and possibly probation.  It is not likely you will go to jail.  I do not understand how they voided out a citation because the BAC wasn't high enough.  If you are underage then .001 is high enough.  Especially if zero tolerance is enforced.  Just make sure to show up for hearings and court.  The worst thing will be your license and the amount of point a DUI puts on.  In MD it is like 8 points for a DUI.  Not sure about CA.  Anyways, I wish you the best of luck!
