Underage drinking, friend woke up in hospital and came home with no citations or anything, what happens?

my friend came off a bus extremely drunk and a police officer asked for his id, took it, saw that he was underage, and took my friend to the hospital. The next day, at 6am, he called me to pick him up. He left the hospital with no citation from the police. Will they mail it or what?

He has no memory of anything, and I do not know what happened after he went away with the police officer.

This was in Pennsylvania.

  1. Typically if an underage kid is brought in for alcohol poisoning they won't issue a ticket AS LONG AS whoever called 911 stayed with the person until the ambulance came. It's called the Safe Haven's Law and it's so that if a bunch of kids are at a party and they're all drunk and one friend is in really bad shape them and a few others (I think the max is like 3 people?) can call 911 and as long as they ALL stay with the kid until the ambulance picks him up, then nobody gets an alcohol ticket. It keeps kids from being too afraid to call because they'd get in trouble, and then their friend could end up dying.

    I'm assuming since the officer stayed with him until the ambulance came, then they had to apply the Safe Haven's Law either way.

    Sounds like the officer did the right thing in getting ER care though.

    If your friend has no memory of what happened, he need to check into AA.

  3. He may get a court notice in the mail or have one delivered to his home. I hate Pa. I really do. Their state and local government is so corrupt.

  4. Your friend was probably taken to the hospital for treatment of "acute alcohol intoxication" or "alcohol poisoning".  He is lucky that the officer took him in for treatment.

    Normally, if a citation was to be issued, it would have been done while he was in the custody of the officer.
