Uninsured car accident. Will their company sue me?

I just had an accident where I was at fault and I have no insurance (my policy expired last month). The insurance for the car I hit is comprehensive plus they have uninsured motorist insurance. If they file a claim with their policy and their insurance company pays them for the damages I did to the car will the insurance company then sue me? If so what will they come after (I have no assets).

Yes, they will attempt to recover what they paid out.  They will not necessarily sue you.  You can negotiate the terms of a payment plan with them.  You are not off the hook just because you do not have any assets.  You may have to pick up a part time job.  You are still legally liable for all of the damage you caused.  Hopefully, the other party does not file an injury claim against his Uninsured Motorist coverage.  You will be responsible for that as well.  Reinstate your policy.

  3. Yes, they will come after you like gangbusters.  You may not have assets but they can and probably will garnish any of your future earnings.

    For starters, you must have some assets. You are on the internet, which means you have a computer, and you were driving a car, which probably means you have (or had) a car.

    Depending on the amount of damage you did will depend how hard they push.

    If it is in the thousands, which, is very likely it is, they will chase very hard.

    They can take items of value including your car, bike, TV, video, strero, DVD player, cd's, DVD's, video's, games machines, etc etc.

    They can also garnish your wages or welfare payments until you pay them back the full amount.

    I beleive that you may also be responsible for court fees, and some insurance companies will add interest.

    The judge may recommend prison or weekend detention for you, or you may have to pay it back the hard way.

    Expensive lesson to learn. Next time get insurance.
