Question:

Uninsured drivers?

I allowed a family member to drive my car because they told me they were insured to drive any car. They crashed the car and my insurance company say that i have breached the terms of my policy by letting him drive. They told me that they would pay for the damage to the other vehicle but will then possibly pursue me personally. Why can't my family member be held responsible for this instead of affecting my insurance as he lied?

  1. you are responsible for your car. you get insurance for your car and specific people you name to be drivers. your insurance company is not going to give in easily because you let someone else drive your car. you should be going after your family member that lied to you.

  2. You are the one they have the relationship with, so you are the one they go after.  If your relative doesn't pay you back, you will sue him.  That's the lawyers' full employment program at work.

  3. No one is Ever insured to drive any car, no matter what.  There are ALWAYS exceptions!!

If they are a household member, darned straight you breached the contract, you have to list ALL HOUSEHOLD MEMBERS!!  It's not HIM that lied to the insurance company, it's YOU, by not listing all the household members!!

Your family member CAN be held responsible - you can sue them!!  That's how you get your money back.  Meanwhile, YOU are legally obligated to pay for any damage done by your car.  Then you can sue them, and try to get it back.

Now, call your company/agent TODAY, and list all the household members on your policy, or NEXT time it happens, you'll REALLY deserve it!!

  4. because you are responsible for your car and your insurance policy. you shouldnt trust other people with things that you are responsible for.
