I was charged with unlawful delivery of alcohol to a minor on July 23rd 08. However, i did not sell or serve the minor. The beer was set on the counter while i checked her ID and was poured out when i determined her to be underage. I was still charged bc i put the beer up on the counter. Now, the question...I'm moving to Hawaii on the 14th of August for work and school. I just got my notice to appear in court on August 19th. School starts the 15th. I live in Kendall County IL. Is there any possibilty that they would move my court date back until my fall break when I'd be able to fly home to appear without missing work and school? Fall break falls mid-october. Or will I have to appear on the 19th? i've never been in trouble with the court or anything. Not even a speeding ticket so i have no idea how any of this works...any info would be great.

  1. u need a lawyer to file in the request. not following the court orders or absence wud lead to ur arrest.


  2. You need to get a lawyer and ask for a Continuance at a time you will be returning, otherwise a bench warrant is likely to be issued for your arrest and you will be listed as fugitive.   Your driver's license my also be suspended.

    As you poured the beer and set it up on the counter prior to verifying the ID, you will likely be found guilty; all the more reason to hire a good attorney and try to plead down to a lesser charge that involves a fine and probation and then get approval from your probation officer to relocate for higher educational purposes.

  3. If you want to fight the case, some courts allow you to call in and reschedule the court date. or before you leave to go to Hawaii, you can go to the court building and ask for the date to be reset.
