Unpaid eBay item (What's next)

I have recently sold something on eBay that hasn't been paid for in a timely fashion (7 days). I filed the unpaid item dispute already and the reason is that they buyer never contacted me back. My question is can when should I re-list the item that I filed the claim for? Can I do it right away or should I wait a while. The buyer has had no contact with me since the auction ended and has not responded to any of the emails that I sent him/her. Any advice is good advice. Thanks in advance.

In this situation I'm getting the impression that the buyer has no interest in completing this transaction.  I would go ahead and offer it as a second chance first to the 2nd place bidder.  If there were no other bids, I would recommend waiting until you issue an unpaid item strike to relist the item.  Once you've issued the strike you are free to list the item all over again.  Essentially you don't want to find yourself in a bind where the buyer suddenly comes out of hiding, pays for the item, then reports you for seller non-performance because you sold it to someone else.  Your best bet is to completely clear this auction off your record by issuing the strike first.
