  1. If a company is violating your trademark, you should consult a lawyer. However, just because they paid to be in a desirable spot on Google does not mean that they are using your trademark. You would have to have proof of the violation.

Any company is allowed to use advertising to attract clients, and it is up to you to make your products or service so attractive to your clients that they will not go to someone else. Business is tough, but competition is good for the economy.

  2. Pursuing Google is a waste of time.

I'd suggest getting a trademark attorney, IF THEY ARE USING YOUR TRADEMARK, and have them write a letter for you. Do not do that yourself. It won't have any impact if you do it.

If they are using your name only and no trademark then a regular attorney that practices civil law would be fine to write the letter.

At best you are going to spend money on this and get them to stop. Don't plan on getting any money out of them.

Best hope is that they are stupid and a letter from an attorney may shake them up enough to stop. If not and they call your bluff then this could get very expensive to litigate.

Then its up to you what your next step is.
