I filed for agreen card and work permit from USCIS with my husband(USC) as the petitioner in 5/6/08. It's been past 60 days and i haven't heard anything. Is it true that after 90 days and no reply from USCIS (Under law) one can go to the local office in their state with their receipts and valid identification and receive a temporary work permit ?

  1. No!  The delay so far is nothing.  But I am surprised that you have not even received an acknowledgment.  Has the fee check been cashed?  They normally cash them within a week of receipt.  If it has not been cashed, maybe they have not received it.  You can always call them and find out.
