Use of Residential Complex for Commercial Purpose (Infants' Nest) in Bangalore?

Hi, We are using a residential complex to run our business of Serviced Apartment called Infant's Nest in Bangalore. Residents are protesting against our commercial activitiy inside the residential complex but we are not bothered. We are even running a Kitchen and an office from the apartement.

They have even made complaint to the Police and MCD but is there any one who can do anything...please let me know.

Can Electricity Dept. cut power connection as we are using domestic connections for commercial purpose?

Can Health Deptt. fine us as we are running a mess inside a residential apartment??

  1. Yes you are expected to receive actions from all departments. Many small scale companies are located at a residential area. But you are running a commercial activity, in an apartment. The residents are every reason to protest, because of noise and smoke and other waste generated at Kitchen. If some one brings a stay order, you are expected to vacate the premises, with in short notice. Even a complaint to City Corporation is enough to vacate you, as the Building is granted only for the Residential purpose. Even, if you apply now, they do not allow you to run, and do not issue NOC.

    But, you have not clearly mentioned, whether the residents have already given the complaint.  If not convince them not to do so for some more time.

    Meanwhile, you can think of shifting the base to some other locality or other place in the same locality. Hence I asked you to take some more time, by discussing amicably, with the residents. Once they file an objection, any thing may happen.

  2. First of all I guess u shud be consulting a professional (which actually wud be the right forum for you)

    Secondly you have your self given all answers, Yes the Police can take action against you , in case your mess causes any repercussion that may lend you in unwanted consequenses.

    If the masterplan of that vicinity depicts the area to be purely for residential purposes than your occupying and using the area for comercial purposes would be p***e illegal.

    same shall amount with the electricity board, your electricity connection may be cut and or you may be asked to pay charges as per commercial rate with retrospective effect with penalty.

    Mind you in Bangalore there have been lots of precedences and instances where court have come heavily on such issues.

    therefore seek proffessional guidance immediately before things get late.
