Question:

VA Disability Compensation Backpay Question?

My husband filed a claim in Feb '07. He received 40%. He added onto the claim in March '08. I know the VA gives back pay, will he receive back pay for the claim he made in March '08 from that day or from the original claim in Feb '07? Did that make sense to anyone? If it doesn't, tell me so i can try to say it a different way.

  1. They might back pay him from March 08. But then again they may not. The VA gives and take money away as they please. They are driving me and my husband crazy right now.

    My husband is filing a second claim for 100% percent right now is at 80%.

    Get a representative, it can be anybody to rep you, DAV, AMVETS, VFW, American Legion. Plus they can answers anything you need help with since they have been there done that

    Get one! It helps alot.


  2. I think I know what you are asking but I can't think of how to put my answer in words. Don't we make a pair. Do this, call the DAV in the morning. Not the VA but the DAV. Here's the number.

  3. He will receive 40% effective FEB 07.    

    If they approve his addition done MAR 08,  they will make the addition effective that date and back pay him to that date.    

    However,  going from 40% to 50% or higher is pretty hard to do as 50% is the magic cut off point for concurrent receipt.   Even if his VA psychiatrist says he is in worse shape,  the VA evaluation gang will probably send him to an outside provider who will do everything he can not to agree with his VA psychiatrist.

    It should have been adjudicated by now.

    Did you file the claim with a VSO...

    Someone not employed by the Dept. of VA ?

    Is he a Combat Veteran ???
