VISA Q16 - Has your relative ever been under immigration proceedings?

Hi, I just married to an American citizen (I'm Japanese, and Japanese citizen...) We're working on our visa, and I stumbled by this question... "Has your relative ever been under immigration proceedings?". I put "yes", because I've been through immigration process before, when my dad (my mom remarried to a Marine, and we had to go through this process so we can all move together to the states)

However, my greencard has expired because I passed 18. Which category should I check? "Removal", "Exclusion/Deportation", "Rescission", or "Judicial Proceedings"? I was thinking of "removal", but I'd like to make sure...

  1. I don't think you have been any of those proceedings. They mean all related to resulted from the illegal immigration. Although I don't not sure what you mean by "green card has expired."


  2. If you are still living in the United States all you need to do is renew your green card.

    You have not been through any of those proceedings.  They are for people who were taken before an immigration judge on formal charges.

    If you simply went back to Japan and let your card expire then you should check "no."

    Are you in Japan?

    Is your husband in Japan or the United States?

    If your husband's in Japan does he live there?

    ************Since he lives in Japan you will be allowed to file the application directly with the US embassy in Tokyo or at the closest US consulate.  This will greatly reduce the waiting time for you.

  3. i believe that if you are already a permanent resident all you have to do is renew your green card. it doesn't matter how old you are because you are already a permanent resident. you shouldn't need to get a visa if you are already a green card holder. maybe what you do need is to get a passport. hope i could help.
