Question:

Valid Contract or Not?

I signed a termination agreement today, August 18th. The contract was dated today and I signed and dated with todays date. My boss signed it on the 18th but dated it the 17th. Is this contract valid still? If you need to know I live in Ohio.

Thanks

  1. Unfortunately you have not given enough information to be able to give a definite answer to this question.    Unless the contract is "time critical" or contains a "time is of the essence" clause, the erroneous date written by your boss should be irrelevant.  What is important in any contract is a "meeting of the minds".  If both parties agree to the contents of the contract, both parties are legally competent and its content is not barred by a Statute of Limitations (the "time critical" thing again), then a contract is formed.  In giving this answer I have assumed that there are no other fatal flaws to prevent a valid contract (such as lack of capacity to enter into the agreement, duress, etc.)
