Vehicle collision claim, old damage+new damage??

i had a car collision couple of days ago, somebody behind hit my rear bumper. There is a little paint was scrached off, and a bit of pushed into.Close to that part i already had damage which was caused by previous collsion, This part of damage actually has nothing to with her,but the new hit worsen the previous damage of my bumper, made the gap little bigger than before. Her insurance company offered me$204.49 for repair, but my own insurance agent came over and looked at it said that will be more than that... Seems like her company has to be responsible for whole bumper repair previous+new damage.

Anyway, i don't mean to take advantage of people's accident, but is this the way it should be?

  1. No that's not the way it should be.  You can get into trouble if you try to claim someone did more damage to your vehicle than they did - as you are suggesting.

    The car auto mechanics can tell if you're lying, in certain instances.
