Vehicle with lien?????

i have purchased a vehicle from a dealer ...i payed cash for it so now it was mine ...the ownership is in my name ....NOW THIS... i get into an accident which wasn't my fault , i'm waiting for the insurance to issue my check but all the sudden the claims department calls me and says that there is a lien on my van and they can't issue me a check soooooooo now what ..... where do i go from here ( i payed the dealer in full ,i have the ownership in my name ,what in the h**l is going to happen now? will they give me my money or what????)shouldn't the dealer have to fix this?

  1. Well, in whose name is the lien or didn't you ask. Maybe the dealer didn't have clear title. Hopefully you have real auto insurance and not just the one with the biggest ad and lowest price in the yellow pages. It will all get sorted out but be a bit proactive, Call your agent and explain what's going on. Don't get nasty, they should be on your side. Do you have the title?


  2. i'd say that the dealer has a lawsuit on their hands if you have a receipt showing that you paid the total asking price for the vehicle with $0 owed at time of assuming ownership. A dealer shouldn't sell a car if it is not free and clear.
