Very complicated situation with my brother's student visa in Canada, Can you help?

He holds Iranian passport and has student visa in Canada. last year in Dec, he applied for Re-Entry visa to Canada, so he can go and visit my mom in Iran. tafter 30 days of the process there was no passport!... 3 months passed and there was no passport. we had to email immigration ( since there is no telephone that can assist you) and they replied that they have sent the passport after 30 days and if we havnt got it yet it means it is lost!!! so we went to Police and got a report, then went to Iranian Embassy and got a new passport. now he had to send his new passport for a new student visa and a new Re-Entry visa so he could go to Iran for summer. now after 30 days his passport is back, and they have not given him return visa and they have attached a letter that it looks like he want to stay in Canada and they dont grant him visa anymore. now since his old passport has re-entry visa till August. do you think he can use that instead?

  1. If you lose any immigration document issued by the Government of Canada, you can get it replaced. You must complete an application and pay a fee. Contact the CIC Call Centre (1 888 242‑2100). They are available Monday to Friday, 8 a.m. to 4 p.m., your local time, except for statutory holidays.

    Please note: Agents cannot make decisions on applications that are being processed by Case Processing Centres or CIC offices, nor can they assist in processing applications more quickly.

    There is a fee for replacing immigration documents that have been lost, stolen or destroyed. A non refundable fee of $30.00 applies and payment must be included with the application.

    If you leave Canada and want to return, you must have:

    a valid passport or travel document;

    a valid study permit if you are returning to study in Canada; and

    a valid temporary resident visa if you are a citizen of a designated country for which Canada requires a visa.

    If you are a citizen of a designated country and you travel to a country other than the U.S. or St. Pierre and Miquelon, you will need a multiple-entry visa to re-enter Canada. If your temporary resident visa has expired or if your visa was only valid for a single entry, you must re-apply for a temporary resident visa at a Canadian visa office outside Canada before you can re-enter Canada.**


  2. You mention the re-entry visa in the old passport - does that mean that you have recovered the old passport and the re-entry visa that is valid until August?  Even if you have, I suspect that the visa has already been canceled in the system, along with a notice that the old passport has been lost/stolen.  In such situations, the old visa cannot generally be used with a new passport - it is not the same case as when an old passport expires while still containing a valid visa.

    That said, the only way you will really know the exact situation now is to contact the immigration authorities of Canada.
