Is it illegal to video tape/make a video at a restaurant?

Depends.  Generally restaurants will allow you to video tape or photograph your own party having dinner or the event you are attending.  I wouldn't think a restaurant would allow you to videotape other people like other diners or the servers, unless you had their permission.  I certainly would not want to patronize a restaurant that let someone take my photo without my permission while I eat.

    Remember a restaurant is not a public place. It is private property. And just like you would be required to get permission before making a music video in the metropolitan museum of art, or you wouldn't be able to walk up to someone's house and video inside their windows, you can't video other people or inside a private building without their permission. If you do take photos or videos that are not permitted in someone else's property, like a restaurant, you may be trespassing (doing something on their property that your permission did not allow you to do). That is illegal.

    If you plan on taking video for some commercial purposes, also remember that even if you have the permission of the location, if you photograph people you need to get a release to use their images.  Sample model releases are available.  People under 18 need to have their parent or guardian sign.
