Question:

Violating on a misdamener can it turn into a felony ?

i got on probation for a roach (can you believe this) and im have 19 days left on this charge and since i lost my job and dont have the money wich is 98 bucks to the p.o. they or going to violate me when i have paid and done everything else that i was suppose to do which was take a drug class which started out to be 60 dollars and ended up being 75 dollars and that wasnt my fault it was theres and if i didnt take that class by a certain time they were going to violate me now that i have only 19 days left on this here they violated me because of the money and the fine was 880 dollars and all i owe is 98 bucks on a 6 months time period so i want to know how much time in jail am i looking at and i know it depends on the judge but for this matter i mean come on lets get real omg this is some B.S if you ask me but hey thats life at times.So if you know someone that has been in this situation could you leave me a answer telling me what happened thanks.

In most states, when a judge gives probation, he first fixes the sentence for the crime and then suspends execution of that sentence upon certain conditions.  Failure to meet those conditions results in imposition of the original sentence.  However, inability to comply is not a violation.  Only willful failure is a violation.  that being said, your ability to comply is determined by the judge, not by you.  If you could have complied by living under a bridge and eating out of dumpsters, and you chose your own comfort over meeting the conditions, then you will be found to have violated the conditions under which you could have avoided serving the original sentence.


  2. Borrow the 98 dollars from a parent, friend, aunt or uncle.      If no one has the total amount then borrow a little from everyone. $10 from this person, $15 from this person, etc... it will add up to what you need.  How about having a "yard sale" on a weekend. Dig out somethings that you can live without and sell them. In the end you will have the money and you won't have to worry about jail time or getting boosted up to a felony. After your final 19 days are up, get another job and slowly pay everyone back one at a time.
