Visa Waiver expired-What are my chances of being allowed back into the US?

I'm in the USA at the moment ATL on a Visa Waiver, i've been so desperate to go home but financialy i'm not doing well and have not been able to purchase a ticket back home. My Visa Waiver expired yesterday.

By the looks of thing i probably won't be able to get home till sometime next week, i know the rules and regulations of a visa waiver and i'm aware that i won't be able to use it again.

I come to the US about once or twice each year this time round i got myself in a big mess.

I've spoke with USCIS, Immigration, British Consulate and so fourth but they all gave me the same answer- that i have to be out on the 10th the day my Visa expires.

I've always had a goal of moving to the US and was planning on getting started this year, What are my chances now of coming back on another visa? or being sponsored by a family member or employer? Or maybe even marriage?

  1. To come here on the VWP you needed a round trip ticket.  What happened to the return portion of your ticket?

    After just a few days in the overstay status you are likely to be barred from ever using the VWP...that means for the rest of your life.


  2. There's a new one, someone who wants OUT of the US.

    Let's face it, with all the other c**p going on, they will have little resources to find you and escort you out of the country.

    If they make a stink about it, too  bad. You knew when you entered the country when you had to be out by.

    Ignorance is no excuse for breaking the law.

What happened to the round trip ticket? ?N way thats not important...returning  to us on a VWP wont work for you next time no matter what...but you still can get a Visa, But it has to be a permanent resident visa coz i don't think they will allow you have any other if you have intentions of staying in the country...marriage..yes you can marry but might take too long and complication might arise. N way whatever you do.....its never too late

If you overstay while in the US under the Visa Waiver Program (VWP), you would be deemed ineligible to enter the United States visa free under the VWP in the future.  You would, however, still be eligible to apply for a visa to enter to the US.  A lot depends, I suspect, on just how big of a mess you got yourself into.

  5. how in the world did you come to the US without a round trip ticket? it is the law for all tourists to have a round trip to all countries,

    i am afraid you will be barred from entering the US, not only you did not need a visa, but you overstayed, and, you will not have an excuse for this overstay, round trip ticked are the law.

  6. You're between a rock and a hard spot.  That's the bad news. The good news is, it might not get noticed.

    When you leave, just get on the plane and good luck when you get back with your finances.

    The next chance you get, apply for a B1/B2 visa, even though you might be eligible for visa waiver. When you get that visa, it'll be moot whether you are eligible for visa waiver or not.

    If anyone asks why you *want* a visa, it's so you can get an extended stay (six months) instead of the visa-waiver three months. Sure, only a few UK people use visas, but a few do. (Remember to fill out the white I-94 on the plane and not the green one.)

    Being barred from visa waiver won't affect other types of visas- if a relative or spouse sponsors you, you're good to go. Ditto any possible employer.
