Visa for my Mexican husband.

I am 5 months pregnant and a Us citizen. I am a Mexican resident and was unable to get my mexican husband a tourist visa due to the ties he has to me. I want to have my baby in the US. What can I do to get my husband to the US. I have been told to do the K1 visa. I am not wishing to live in the US. What can I do to get a visa for him? I will do the K1 if it gives me time before december when the baby is due.

  1. Your baby will still be a US citizen, even if it is born in Mexico due to the fact that your a US citizen.  


  2. K-1 is a fiancee visa.  You're married already and he's not eligible for a K-1.

    A K-3 visa is a spouse visa.  If you live in Mexico, and you do, you can do what's called Direct Consular Filing.  This will cut down the time it takes to get the visa. You'll need a US family member to act as financial sponsor since you have no US income.

    You file I-130 with the US embassy in Mexico City or with the closest US consulate.

    1. You lived in the United States for more than 5 years.

    2. You lived in the United States for 2 years after the age of 14.
