Visa process....?

My Man and I requested for an Fiance(e) Visa..I am here in Germany and he is in the USA..Can i still travel to the US to visit him?Somebody told me as soon as the VISA is in process it is not possible

  1. It's possible, but you need to make sure you bring ample proof of your intention to return to your home country and wait for the visa to be issued.

    When you come to the US border, the Customs and Border Patrol (CBP) Officer will be able to see you have a pending visa application. They then have to decide if you are genuinely coming to the US for a visit, or to move here before the visa has been issued. You'll get far more scrutiny than you would have if you were just a normal tourist who didn't have a pending visa applications.

    Take proof with you, such as a letter from your employer saying you're due back to work at a certain time, a rental agreement on any property showing you still live there. The more evidence you have, the easier it will be to convince the CPB officer that you don't intend to stay in the country once admitted.

    But always remember, no matter how much proof you take, you could still be denied entry. It would be far easer for your fiance to come to German and visit you, as he would be seen as just a tourist.

    The potential problem is that since you have a fiance visa pending approval, coming to the US to visit yields credible suspicion that you might want to try and stay without waiting for your actual visa to come through. The responsibility to let you in or turn you back rests with the immigration officer you'll be facing after you land. If you provide sufficient proof that you intend to depart and return to your country to wait for your visa, they may let you through.

    But yes, it's allowed to do what you're thinking of doing.

    On the other hand and if you wish to save yourself the stress of flying all the way from Germany to the US knowing you have a chance of being sent home right away, maybe without even getting a chance of seeing your significant other, then you should stay in Germany and have your man visit you there if possible.

    Seeing each other while the petition/visa is processing is good, too, because it shows that the relationship still exists, and you may have to show that if and when you are interviewed at the US embassy or consulate in Germany.

  3. It is legal to do BUT the chance that you will be refused entry is about 99.9%. YOU are now considered a visa fraud risk! He CAN visit you without a problem as long as nothing else is goin on(overstay in Germany, etc.)
