My husband was refused a visa to the US today. How long does he have to wait before he can go again to get the visa. He is Mexican. Can we go to another Mexican City and make the date for his visa?

  1. If your husband was denied a visa based on section 214(b) of the Act, it appears that they felt he needed an immigrant visa, not a nonimmigrant visa.

    The consular officer will reconsider a case if an applicant can show further convincing evidence of ties outside the United States. Applicants refused visas under section 214(b) may reapply for a visa. When they do, they will have to show further evidence of their ties or how their circumstances have changed since the time of the original application.

    If he was denied a visa based on section 221(g), he needs to gather up the documents he lacked at the interview and apply again. He needs to look at the denial information sheet to see if he was denied under 214(b) or 221(g)


  2. Since your husband's previous application and refusal is in the worldwide consular system, it's not likely that he'll succeed anywhere else.  He can re-apply, but shouldn't waste the time and money unless he is sure that he did not represent himself well at his prior interview and believes that he will be able to convince the consular officer that he does not intend to stay in the US.
