Question:

Visiting my fiance in the US from China?

If I want to visit my fiance in the US, what kind of visa should I get? Is it almost impossible for a single woman to get a visa to the US?

My fiance and I are not to get married in a couple of years. We only want to spend more time together to know each other better in person. The problem we have is he has no enough time to visit me here in China, working on his degree four quarters a school year with only a week's break in betweeen (He already suspended his studies for a quarter to visit me in China). I have time on vacations (I'm a college teacher) but it's just so hard for me to get a visa to visit him.

My fiance is thinking of bringing me to the US for a visit on a fiance visa. Would this work? But I only want to visit him for a month or so and then come back. Anyone who knows something about this please help. Thank you in advance!

  1. If you want to visit for a month or so, you need to file for B2 visa. To get approval, you need to present proofs of strong ties to your country, that you have all the intension of coming back after visit. Although it is always better to be honest at the interview, but mentioning about USCitizen might cause red flag.

If your fiance file for K1, you have to get married within 90 days of your entering to US.

    Good luck!

  2. Well, Hot Chick is right to the extent that if you want to stay in the US legally, you must marry within 90 days. However, you are allowed to change your mind, not marry, and leave within 90 days. That does not violate any immigration law. However, while that might prove easier than getting a tourist visa, it does take anywhere from 8-12 months to process the petition and get an actual visa, assuming you are approved, which isn't guaranteed, so it isn't exactly fast. Perhaps by the time it's processed the two of you might actually be ready to marry.

Edit: I repeat, if you want to stay in the US and become an immigrant, you are obliged to get married within 90 days, to the petitioner, of course, and  then file the proper paperwork to become an immigrant. But, you are not legally obliged to actually marry. If you don't, you must leave within 90 days, and you can't change to any other status, or marry some other American and become an immigrant through him, unless you leave and get an immigrant visa to return. But, getting a K-1 visa does not force you to actually marry. People are allowed to change their minds, as long as they leave. However, with your stated intention, you really should apply for a tourist visa.

  3. to get a tourist visa in the us, you have to prove that you have no intentions of immigrating in the US.

if your fiance files a K1 visa  (fiance visa)for you, you guys have to get married within 90 days upon entry in the US.
