ok, so im a U.S permanent resident but when i lived in Costa Rica i had a kid 14 years ago, he has my last name and everything, I just want him to visit me, that's all.

Do I have to go to Costa Rica and get his visa? or he has to get it on his own if his mother takes him to the U.S embassy?

what's better? he is not moving to the U.S, he goes to a private school there and has everything but i just want to spend sometime with him here in the U.S a month or two.

  1. Well, he'd have to apply for a visitors visa at the US embassy, but I certainly wouldn't guarantee he'll have no problem. He and his mother will need to go, but you don't need to. If they can convince the interviewing officer that he intends to return, he should be able to get a visa, but that won't necessarily be easy to do.

  2. His legal guardian in Costa Rica can take him to the US embassy to apply for a visa.

  3. He needs to get a visa at the US embassy in CR.  He needs to go with his mother.  He needs to bring copies of his school grades etc. to demonstrate that he is not going to stay in the US.  He also needs to bring his birth certificate and his mother needs to bring her ID as well.

Should be no problem.  Don't know how long it will take, though.
