Visitor Visa to Fiance Visa?

My boyfriend lives in abroad. He wants to obtain a visitor visa to come visit the US and get to know me and my family better. I am wondering: if we do get engaged while he is here (we're still just getting to know each other better), can we apply for a change in his visa status to a Fiance visa and then get married and apply for his permanent residence? I want to make sure we do things correctly- legally. It's complicated.

  1. do a google search for immigration usa. I researched this one I dont know about comming to usa then transferring the visa but I do know that once you have a finace visa you have to get married within 3 months. Also a lot will depend on the country he comes from.


  2. Well, he can't change from B1/B2 visitor status to K-1 fiance status, and if he could that would mean you would have 90 days to get married and file the immigration papers. So, if you're just now thinking of getting engaged, maybe that's not really what you want in any case.  Still, if this is something the 2 of you decide to do, you could certainly file the fiance petition the day after and get it going. It takes anywhere from 8-12 months to get the petition processed, approved and sent to the embassy overseas. If he's on a tourist visa, normally he can remain in the US for 6 months anyway.

  3. No. Changing requesting a change of status from a tourist visa to a permanent resident is considered prima facie evidence of visa fraud (even via a fiance visa). By your own admission what you are planning is visa fraud. Have him return to his own country and then apply for a K-1 visa.
