  1. Websites are a collection of copyrights.  Moreover, a website has an individual style/flair that is capable of being protected by copyright laws.


  2. There are legal questions of whether a website (digital transmission) constitutes "publication", under the definitions of 35 USC 101, and if not, whether the existing copyright laws should even apply to infringement by websites.  Similarly, under the 1909 laws,  U.S. copyright protection for "music" didn't include sound recordings of performance of the music (and didn't until 1972).

    Other website issues include: whether parts of the HTML structures are copyrightable as "creative works", or rather functional codes that are non-copyrightable.
