WHERE AND HOW TO FILL I -130 ?

we will marry soon in nepal.My wife is a green card holder.I also want to go to USA with her.But we do not know where can we fill i-130 .Can we fill it in Nepal or she have to go to USA and fill it?Where,how to fill and what are the documents required?Thanks.

  1. your wife as a greencard holder cannot sponsor you..she has to be a u.s. citizen before she can sponsor you.  if you two wish to go to the u.s. after marriage, u need to enter under a different visa, maybe a student visa? until she gets her citizenship and then sponsor you.  to get citizenship, she needs to apply 5 years from getting her greencard.  then after she passes the interview and gets her citizenship certificate, she can apply by submitting different forms, I-130 being one of them w/ many others.  good luck!


  2. Lots of people trying to help, but not a lot of correct information. If you marry, your green card holding wife can file an immigrant visa petition for you under the F2a family preference category. However, those petitions take about 5 years before they can be used to go to the US.Until the petition is valid, you wouldn't be able to go to the US.  She would not be able to file the petition at the embassy. She'd have to go home and file it in the US.  

    Only U.S. citizens can file a fiance petition, or K-1. Green card holders can't file a fiance petition at all.

    So, while your wife could sponsor you, it will take quite some time before you'll be able to join her in the US. If you do get married and she files a petition for you, it can be upgraded to the IR-1 category as the spouse of an American, if she becomes a citizen while you're waiting. In that case, she would need to inform USCIS that she has an outstanding petition for you, so that they can contact the National Visa Center and have it sent out for your immigrant visa interview.    

  3. Listen. It is way easier to file a k1 visa rather than a k3 visa. regarding processing.

    k1 is fiance k3 is for spouse. if u can get a fiance visa , u may just have to wait atleast 3-6 month from ur country and come to U.S legally with a 90 days visa for the purpose of marrying. after that u can now just file for ur k3 visa (spousal) therefore u may not have to wait there just here. HOW COOL RIGHT? Only thing u have to do is a proof of ur relationship. atleast 2 years been known each other. pictures of u and her, and family and freinds.  videos. email or chat scripts. phonecalls, gift that was sent or was received money order anything that cud prove that u both love each other and that is not a fraud. then k3 the spousal one well that shudbe like a year or more.

    WHERE to file. well since she is not a citizen in ur country, she wil have to file to lagunal niguel. in other words. she will file from the u.s and u stay there and just wait for ur interview good luck!

  5. Go to the USA embassy, they have step by step instructions upon how to do things. Its actually very easy, buy its also kinda $$$$$
