The police have a lot more stuff to do than to monitor YOUR usage of the internet.  They really couldn't care less.  Now, the RIAA is another matter.  But that's a civil matter.  And if you're using a router, they still don't know just exactly who is doing the downloading.

So, as Smokey the Bear once said, if you can't stamp out forest fires, then píss on 'em!

Short answer, you can go to prison for illegal downloading.  Slightly longer answer, most of the time if you get caught you just have to pay for every song on your machine or that you ever downloaded (very very expensive).

They can get info off the hard drive that is deleted so be sure to soak in water and throw it away in some other trash not your own.
