Wage garnishment motion objection in NJ

hey, my husband's wages have been garnished as of two paychecks ago for a credit card debt. we are in the middle of filing chapter 7 bankruptcy. We understand that once the paperwork goes through that all garnishments will stop. However, we are struggling with this garnishment. We wrote a statement to the court to stop or decrease the amount of the garnishment. We received a notice back today stating that we can file a motion hearing. We also got a paper back saying 'wage objection is being returned due to motion hearing' does this stop the garishment until the court date or will the garnishment continue until settled? I just want to know what to expect at my husband's next check. Thank you all for answering and understanding the situation.

  1. The garnishment will continue until the court orders a change. That won't happen until the hearing.


  2. You need to finish filing for protection.  Filing Chapter 7 bankruptcy will immediately stop a wage garnishment in progress and cancel out any existing wage garnishments, provided that the court allows that debt to be discharged.
