Want to marry a non us citizen on a student (f-1) visa.?

Now we just want to get him a green card, we don't want him to become a permanent US citizen, he already has dual citizenship. We don't plan on living in the States forever, just for a few years after the marriage. Is there a way of doing that, of not making him a permanent resident? What forms would we have to fill out?

  2. A green card is a permanent resident card. You need one to remain for 3 years.

    The F-1 is a non immigrant visa so he will have to return to his home country and wait for the proper visa.

    He can't remain past his F-1 date to wait for the green card.

  3. You cannot apply for a person not to become a resident. He already is not a resident.

    Having a green card does not mean that someone will become a U.S. citizen. Green card holders are under no obligation to apply for U.S. citizenship. They can remain green card holders for decades if they choose.

    If you don't plan to live in the States forever, that's fine. When he decides to move to another country to live, he can turn in his green card. No problem. If he turns in his green card and moves to another country, that will make him a former permanent resident.

    You'd fill out a form I-407 to surrender the card and give up permanent resident status, but first things first. He has to be a resident before he can be a previous permanent resident.

    If he wants to adjust his status from F-1 to permanent resident, the whole process would start with a petition, form I-130, filed by his U.S. citizen spouse.
