Want to request an increase in child support??

My child's father has been paying child support since she was 2 yrs old (she is 10 now). Outside of child support, he does nothing for her. He does not spend time, nor take out time to spend with her even though he has a girl with 3 kids, that are not his that he sees everyday. He even moved back home (2 hrs away) without my knowledge, because he got into legal trouble that made him lose his job. In the 8 yrs that he has been paying child support (which hasn't always been consistent) I have never taken him back for an increase even when I think I deserved it, but as of a year, year and half ago, he took me back for a decrease. As stated above he does nothing for my child, not even so much as phone call, except maybe on her birthday. I supply her every need, and granted his child support helps, but she needs more than what his child support gives. The older she gets, the more she needs (i.e. for school functions, activities, clothes,etc) and I wanted to know that even though its been only a year, year and half, could I take him back for an increase? Thanks.

  1. In most states, support can be reviewed annually, but will only be adjusted if the new amount is +/- 10% of the current.

    Don't get hung up on how much extra you spend on your child or the fact that the father doesn't spend time with her.  I tried that argument years ago and it holds absolutely no water with the Child Support Agency.

    Good luck.  Sounds like you & your daughter deserve better.

In Ohio, you can only request recalculation of support once every 3 years unless there are special underlying circumstances.  You would have to check with the child support agency in your area.  They should be able to answer this question, but in general support doesn't go up just because the child gets older and has more needs.

  3. Go to someplace to see if you can,  Sounds like he is an A$$.  What does your daughter think of him?  I would definitely ask for money from him.

  4. This is done in court. You would need to prove an increase (substantial) in his wages. The fact that he doesn't do visitations or help in any other way is mute in this situation. He is doing what he was ordered to do.

  5. You can only get an increase if his income has increased in the last year and a half. Whether he sees the child or not will not affect the amount he has to pay, only how much income he has effects that.
