Warrant check when getting New York state ID.?

I have a parole violation warrant that is over 6 years old from a different state. I asked my parole officer in that State at the time to transfer my parole to a different State. He told me no and threatened to send me back to prison if I did not find a suitable place to live in that county. So I absconded. If I turned myself in it would take 18 months to go through the system. Then I would have to do 6 months in a work release center due to the fact I have no Parole Address in that state. At which point I would be forced to live in that State for the remainder of my parole. My life is here in NY. I really don't want to lose everything that I have and go to prison for 2 years. I made bad decisions. I know I am stupid. I have changed my ways and live on the right side of the law now. Which is obvious as for 6 years I have not been arrested. I want to get a NY state ID card. I am afraid they will run a warrant check and arrest me. Do they run warrant checks when you get NY state ID cards? I called the DMW and the lady said to the best of her knowledge no they do not. Can anyone give me a for sure answer? Please no stupid turn yourself in answers. I did 5 years in prison on the original charge and I did not enjoy it enough to turn myself in to do another 2 years. The crime of burglary was committed in 1997. 11 years ago. Seriously I have changed and have a daughter in this state. I really don't want to be forced to live in another state for the next 7 years. Thanks.

  1. well there is really nothing you can do. Cause they the system is like this once they enter your ss number that warrant will automatically pop up now remember they can tell you any thing over the phone just to get you there and once you are there and they arrest you (then what)

    So the best thing for you to do is get an attorney and let him do all that for you. He can get it to wear they might dismiss it because you have not gotten in trouble in the last 6 years, basically the attorney will make a plea bargain with the prosecutors to help you, but you also have to remember that you did violate parole, there is a possibly that you will have to do the rest of your jail time( if not more). Good luck... You make sure you do what's right for your daughter's sake.

I have yet to be checked for any out of state warrants (as of mid-2007) when getting a DL in another state.  Furthermore, the DMV is not a police agency, so even if they did see a warrant, they'd be powerless, or at least disinclined, to attempt arrest.  The worst that would happen is that you'd be advised that a DL could not be issued due to outstanding warrants that you'd have to clear up before qualifying.

    While warrants, themselves, may never die out, databases are not limitless and room has to be made for new, more recent info.  Old warrants, depending upon severity, often fall through the cracks.  LEO may not like to admit to this, but let's face it, there is reality and people DO get away with it.

  3. Yes, they'll do a background (warrant) check, especially if you don't have any present ID.  (Patriot Act)

    Seriously, you have to turn yourself in to get it resolved.  Get a lawyer to see what can be arranged.

  4. You'll be living in another state while you're in prison....

    You won't get another chance for parole... you'll finish your sentence in jail.

    You can run, but you can't hide. The longer you wait, the worse it will be.

    In fact, you can have a new charge for fleeing the state and 'Flight to Avoid Prosecution"...
