suffered mild whiplash,passenger suffered hip and lower back injuries.truck damages were $5000. what is our claim worth?

  1. You should turn the whole thing into your insurance and let them fix your car and go after the guy.  Don't spend any money yet though


  2. Where to do plan on getting the money? From the other driver or your insurance? Because you used the word claim, I'll assume insurance. Make sure you have Uninsured/Underinsured Motorist coverage, that will cover you and your passenger's injuries. As for the truck damages, hopefully you have Collision coverage or Uninsured/Underinsured Property Damage. Both will be subject to your deductible.

    As for the actual dollar amount you should expect, there's not enough info here to say for sure. Assuming you have the coverages above, they will pay for most of your medical expenses and the repairs on the vehicle, less your deductible, and some money for lost wages if you were unable to work. Unless you or your passenger have sustained permanent injuries that have affected your ability to live a normal life, don't expect much for "pain and suffering". The lawyers on daytime television commercials lie.

I assume that you are filing an uninsured motorist claim against your own policy since the other vehicle was stolen.  The owner will not be responsible for your potential injury claim.  You must have either Collision of Uninsured PD coverage in order to get your vehicle repaired.  If not, you will have to file suit against the person driving the vehicle.

    Regarding case value, nobody can answer our question without additional information.  

    What state did this loss occur in?  Just because you may have been injured does not mean that you are entitled to any monetary compensation.  The threshold requirements vary from state to state.  Some are monetary, some are verbal, and others you have to sustain a "serious" injury.  Are you still treating?  Lose anytime from work? Do you have PIP coverage or medical payment coverage?  If so, your meds will be paid under these coverages.  

    Appears your injuries are very minor.  Assuming you are tort eligible, the adjuster will secure all of your medicals and evaluate your claim based on the nature and extent of your injury, treatment and disability.  If your medicals and lost wages are outstanding, they will be included in the settlement.    Both you and your passenger will be settled separately.  You don't have a joint claim.

  4. You have no claim against the insurance company that covers the stolen vehicle.  They can decline your claim on the basis that they are just as much of a victim as you are.  I would approach my own insurance carrier & submit an uninsured motorist claim.

    You can also proceed with a civil suit against the driver of the stolen vehicle.  The court should be approaching you on restitution amounts.

    FYI....there is no set formula for settlements.
