Question:

Was my car illegal towed from my driveway?

I live in a Chicago suburb. My car was towed when I was away at work from my driveway. Apparently, a neighbor had reported the alarm going off. A police officer came by and requested the vehicle to be towed.

Is this legal? Shouldn't I be given a ticket or some other notice first?

  3. It doesn't sound legal to me.

    It must be Daley's new plan to raise more money for the city.

  4. you should have been called by the police first and asked to come home and turn it off, or the police should have found who/what set the alarm off (or just burn your neighbors house down because it wasn't really going off)

  5. It would be unwise to take this to court without consulting the officer as to what law or bylaw he was acting on.

    If there is such a law, you might be able to use that law to get someone's house towed away if the residents are making a lot of noise.

    But most municipalities have given officers legal protection if they move to silence barking dogs, cars that have blaring horns etc.

    One can not protect an errant vehicle whether it is on your property or rolling down the street. You have to control its action, or failing that a police officer may.

  6. .  I always wondered if the police had a way to turn off an alarm that won't stop screaming.  I don't think they can tow a car because of an alarm.  There would be another violation. Were you blocking anyone?  I guess a Public Nuisance might be the violation if it alarmed for 8 hours.

  7. wow that is harsh.  I would call one of those lawyers that only charge if you win a case about the legal stuff. sugar in the gas tank wouldn't hurt to teach the neighbor a lesson though.=p

  8. in california if a car alarm goes off for 20 minutes and no one takes care of it, the car can be towed.

  9. Do you know which neighbor? Get even! Just kidding.. but maybe you can talk to the cop who requested the car to be towed.
