Question:

Was rear ended with my two month old in car should i make a claim for him?

he wasn't injured but took him to the er anyways. He has been fussy took him to his doctor was told he is sore from the accident. Don't know if i could compesated for that?

  1. Wow i really dont like people that sue for a living.... espically when he wasnt even hurt,

File a claim for what?  Because a two year old is acting like a two year old?  Please don't teach your child that an accident is a way to get something for nothing.  If either of were injured, you are certainly entitled to not be out any money for medical care, but don't you think its a little outrageous to say that your child is "fussy"?

  3. Ask your insurance company. However, I think it would be hard to prove that a baby is fussy because of an accident, and that the fussiness means you are owed money.

  4. I suggest you file a claim with the insurance agency of all the people that was in your car including the two month old child. That will cover the medical expenses in case anything happens within the next 6 months. Sometimes things doesn't show up until later and it's better to let the insurance agency know who was in the car at the time of the accident.  

  5. File a claim just in case it turns into something.  If you do not, you cannot get anything if something is wrong.

  6. Yes, take them to court.

  7. In all cases, let your insurance company know so that should a related injury develop in the future, there is a claim already on file to refer to. I presume there was no vehicle damage as none was mentioned but it is important that your insurance company knows in case the third party makes a claim with their own insurer.

  8. Seriously? No just be thankful he wasn't injured.  How are you going to be compensated for him being sore when he didn't require any medical treatment?
