Was the car accident my fault?

I signaled left and planned to make a U-turn in an intersection. There were no cars coming in any direction except the cars behind me. It was a small intersection with one lane in each direction so i had to first go to the right to make a big enough turn so it wouldnt have to be a 3-point turn. The car behind me thought i was turning right since i moved to the right first even though i had my left signal on. Since she thought i was turning right she went around me to the left trying to pass me as i was coming around to make the U-turn and she hit my driver side door.

  2. Her fault completely. Usually whoever hits who is at fault unless it was both a head on. I said usually as there are always exceptions like a maniac running a red light or a stop sign or crossing into your lane. The person that hits the other car is usually at fault because they were the one who could of avoided the collision by braking but instead crashed into the other car who did not plan on getting hit.

    Although the other driver most likely did not plan to hit you she could of prevent it had she been more careful and stop assuming. First if she hit you while you were still turning she was definitely either speeding or following to closely or both. Also she assume incorrectly that you were going right when you had your signal on. She shouldn't have assume and just waited. She was impatient and that caused the accident.

    Unless she denied you had your left signal on. If she did agree that the left signal was on but thought you were going right and told this to the police then she has no case whatsoever.

    Big rigs and buses always turn wide to make turns it is totally legal. They start by swinging from one side to the other just like you in order to complete the turn. I'm only in CA but I would say this is true for all 50 states.

Yes it would be your fault, unfortunately.  Even though the other car did not yield to your signal to make a left turn, since you veered right to swing wide, the judge will say it's your fault for attempting a turn you could not complete safely.  I was stopped for a similar incident, and was told next time to just go around the block.

Your car was moving right, so the person behind had every reason to believe that is where you were going.  Traffic going through the intersection has the right of way, you cut in front after leaving the centre of the driving lane, plus you made what is illegal in many cities, especially at intersections on undivided 2-lane roads, a u-turn in an intersection.  Your fault, from the information you have given, sorry.

  7. I would say that it would be your fault since you went right first to make the U-turn but as stated above you will need to check with you local laws concerning U-turns.................

  8. definitely her fault, but it depends on the state your were in as far as what the specific laws are.

    Never guess at what the other driver is doing, she had no right to try to overtake you until you made your turn
