Question:

Was the court right in refusing the Mehtas the right to abort their baby?

For those who don't kno,Nikita Mehta is 25weeks pregnant.A recent test showed tht their baby has a congenital heart defect and will hav to undergo a surgery,the moment it is born and vl hav to live with a pacemaker for the rest of its life.Since abortion after 20weeks of pregnancy is legally barred,the Mehtas filed a plea in the high court asking permission for the abortion.They said they don't want a sick baby. They even turned down offers of help from NGOs in raising the baby.

But the Court refused to grant them permission saying tht after 20weeks,doing abortion is equal to murder and since the medical reports confirm tht the baby is not deformed(only its heart has a problem),aborting it would be like mercy killing and hence it can't be permitted.

What do you think about it? I think the court is right. Do only perfect babies hav the right to live in this world?

  1. I don't understand people like that. Who's to say that this child won't make a significant contribution to the world? Just because they are sick and will need help (the pacemaker) to live doesn't mean that they aren't people. I think these people are sick. If they don't want it fine. Find a couple to adopt it that does.

    I honestly think that they are the type of people who you would find in a storage unit in the middle of getting an illegal abortion. It's sad and after that baby is born they are the ones who should be shot. (Not litteraly but this just makes me so mad.)


  2. The court has expressed its limitations... that they are bound to the existing rules...

    Legislature should come forward and amend the 4 decades old rules... that need revision...

    Doctors have played irresponsible role and created confusion... they should have given unambiguous statements and should have certified that the child might have serious deficiencies... and may not live a healthy and happy life... and will die multiple deaths... by each passing moment...


  3. No-one can say what they would do, unless they are in the situation.

    I feel very sorry for that poor child, and that poor woman.

    Maybe, she truly can't deal with a child like that at this time. My friend had twins, one of them has had 3 surgeries so far. It's tearing her apart.

    Living with a sick child is totally life-changing, and absolutely draining. Unless you've had to do it, you really can't say what you would do.

    My friends baby has to be checked. Every 1/2 hourin case he stops breathing, or gets his tubes tangled. She hasn't had more than 25 mins sleep, for 5 months. 5 months people!!

    Personally, I couldn't have an abortion. But it's her family, her body, and only she knows what she can deal with.  

  4. NO i agree with the courts, a baby having a pacemaker isnt the end of the world. that child can still grow up and be healthy and still do the same things that most peope can do!

    If however the child had zero chance at a normal life and would need constant looking after MAYBE i could see thier point of view, i just think its selfishness on the part of the parents.

    Some people struggle having one child, these parents should be grateful instead of being so selfish. maybe they dont deserve that child at all...............

Totally agree with the court on this case.  At this stage of development the child has already formed it's nervous system and will feel anything done to it.  Can you imagine being slowly cut to pieces and pulled out while feeling everything and being incapable of doing anything to stop the torture?

    They must be pretty heartless to want to do this to their child.

  6. I agree with the court. If the baby had no hope of living life...i.e. would be born a "vegetable" then I think abortion could be considered but this is just a pacemaker.... geez. The bub might not be perfectly healthy but if it were my baby it would still be perfect

I think it's a tad sick that they would kill their baby because it's "sick". yes, living with a heart condition (or mental, physical or any other condition) would be difficult, but, it's your baby, your flesh and blood, and that alone makes the baby perfect. For crying out loud, there are families out there that WANT to adopt children and babies with disabilities because they have the resources, and those babies aren't even their flesh and blood. If this family does not want to care for the baby, the least they could do is put him/her up for adoption instead of killing the poor baby.

    In my opinion, every baby is perfect. Even one with a heart condition.

  9. I agree with the court. If this baby had some serious issue like he'd be bed ridden with out use of all his limbs, speach and brains would i feel they should get it aborted.

    They say their are chances he may be normal or just need a pacemaker. Thats not so bad.

    What makes me sad is i hope this child is treated properly after birth and never finds out that his parents fought so hard to have him aborted.

The court is right,i could never contemplate aborting my own flesh and blood despite if they were deformed,had an illness etc.the parents are just selfish,not wanting a sick baby.its their child,they should love it despite its problems.i find them disgusting asking to get rid of it.i take my hat off to that judge.

    The court is not using common sense. How good is it to bring a baby which has bad health and seeing it struggle in front of our eyes.

    How difficult will it be for its mother (Nikita Mehta) to see her baby struggle in front of her own eyes. Why does not the court think of this point. Instead of killing the baby after its birth it is better to abort it b4 it can see this world.  

  12. Well the verdict of court is to be respected as the court has to act only according to the LAW. It cannot trangress limits of law. The court has rightly pointed out that it is now upto the legislature to consider these sort of exceptional conditions and amend the law accordingly.  

  13. i agree with the court.  I don't understand why anyone would fight that hard to kill their baby???

    Particularly when the child can live a normal life after having a pacemaker fitted - and presumably get a donor heart somewhere in the future. There would be some hard times through all of that - but not enough to get rid of the baby.
