Was this guy punished too harshly for indecency?

An Arizona Diamondbacks baseball fan was at a lazy Tuesday afternoon ballgame with a relatively light crowd.

In between one of the innings in the game, very hot model cheerleaders took the field and he got aroused by it.

Because the baseball fan in the stands had an "erection inside the pants" and it was blatantly obvious to the people around him, he also had premature dampness,

he was removed from the field by police, taken in handcuffs, and put in jail on charges of 1 count of a lewd act. He could face up to 2 years in prison.

Is this too harsh? Is there a defence for this?

Is this a true story?  If so, I would  say he has grounds for a law suit.

He should have used some clothing to hide his reaction. Otherwise, it is way too harsh to "punish" somebody for a natural, if somehow hidden, reaction.

The charges listed on the booking sheet mean nothing.  The prosecutor determines the charges.  If all that happened was he got an involuntary errection and ejaculated, he is unlikely to face any charges.  As that is practically unheard of in any male over 15, I suspect that he was jerking off in public.  If that is the case, he might very well face some sort of charges.
