Waviers...?

my husband did a voluntary departure about two months ago and hes now in mexico... im going to mexico in december and we plan on filing a wavier but which one will we need to file? the wavier of grounds of inadmissability for $185 or the other wavier for $545... can a lawyer down there do it for us also??? and how long will it take... we do have in an I-130 petition wich has not been approved or anything yet...

  1. No, no, no.  Before you file for the waiver you have to file for a Visa first.  You need to file an I-130, I-864 and G-325A with the USCIS.  They will then schedule an interview for him at the closest US consulate to his home or the embassy in Mexico City if that's the closest.

    He'll be rejected at the interview due to his immigration problems.  At that point he'll file an I-601 (Waiver of Inadmissibility).

    If you file, here, now, you can expect his interview to be sometime next summer.  It's going to take about a year.

    If you use an immigration attorney then you need an American one.
