Question:

We are British, over in States on student visas. I am pregnant. Will baby be British or American? ?

We have other kids - all British. This is a surprise addition. Will she/he be considered American at birth or British? Can we choose which they are? Will it be a mark against us if we finally decide to apply for permanent visas? I don't want to have to go home to have the child as it will mean months away from my family...

  1. Your baby will be both American citizen by birth and British by descent as long as you register him/her at the consulate. When you try to apply for a permanent Visa, your child's birth will not have a negative impact, as long as your student visa stays alive.

No - it won't be held against you.  Your child will get an american birth certificate, and you can use that to get him a SSN and american passport.  In order to get him a british passport, you can send your birth certificate and his along with the application.  Or you can apply at a British embassy for a certificate of birth abroad, which is the equal of a British BC.

    If you Stay in America, your baby will be American, if born on American soil.. As you are British, you can apply for a Brtish passport for your child. He/she is also entiltled to have an American passport, and an american SS#..

    Im British, and had my Daughter born in America, she is American, and British.. A dual citizen..

    Your not breaking U.S. law for having your child here. i don't see how it will be held against you.
