We are planning on moving out of state can my ex stop me from going?

He has never taken me to court for visitation and he doesn't visit with him very much when my son goes to his grandparents (my ex's parents). I am trying to find out if he can do anything about it. I have custody though.

  1. If his pistol is oiled up that might be a deterrant to your leaving. Talk to your solisitor and make sure it's cool. If so, just bolt and don't telll the DOLT anything.


  2. All depends on your custody paperwork.  Get it and read it.

    You may not be allowed to move out of state or can only move within a certain distance.

    My ex CAN NOT move more than 20 miles from me. It was ordered and agreed to.

    But, read your custody papers and or call an attorney.  Each case is different.

Depends on what kind of custody you have.  If you have sole legal custody with visitation up to you entirely, then you have the right to go wherever you want.  He can petition the court in his state and have it transfered to the state where the children reside to dispute your moving, but unless he does that I wouldn't worry.  If you have full custody you have the right to do what is best for the children.  

    His poor visitation history could bite him in the rear if he chose to claim that he can't see the kid because of distance as you could argue he hardly saw the kid when it was convenient.

  4. See an atty because you don't want to risk kidnapping charges.

  5. Your best bet is to contact your attorney and find out what is legal where you live.

  6. my dad got custody of us in 1981, wanted to move to TX for a job and my mom stopped him...he probably can.

  7. It depends on the laws where you live. Some states say he can stop you and some states say he can't stop you. I have a friend that has an ex that moved to a different state, Because it is legal in the state where they are from.

  8. no he can't, but do try to keep the gate open so he can see his child when & if he can get the money to come see your son.
