We filed wrongly using my wife's ITIN. Should we file an amended tax return?

My wife already had her SSN in Nov 2007. I filed as Married filing jointly and left her ITIN as it was in the year before thinking that what difference it would make in regular tax return. Now of course you do not get Tax rebate if your spouse had an ITIN. Would filing an Amended tax return help now or shoud we wait til our 2008 tax file return as written in most help pages????

  1. The amendment will not result in a stimulus payment.  You will be eligible for the money you missed this year when you file your 2008 tax return.


  2. As far as the rebate, there is nothing to amend.  Fix it next year (update your software to show the SSN so when you install next year's software it will import the SSN rather than the ITIN again).

  4. If you file an amendment with her SS#, you will very likely get your stimulus payment this year.  Most changes on amendments don't affect the stimulus payment, but this can.  In the explanation section be sure to add the line "please refigure my stimulus eligibility"

  5. You will have to check with the person that helped you with your taxes.
