We need to make someone redundant. we bought the company as a going concern 8 years ago?

we gave new job descriptions 8 years ago. the business had been as a sole trader before and the person worked for them before for at least 8 years. in total the person has worked here for over 16 years. we need to make them redundant to save money and the business in the long run. Do I have to pay 16 years redundancy or can i get away with 8?

There job is no longer there and all attempts at trying to retrain them are falling on deaf ears. As they say for 4 years retraining at college they will be 50 +. They are not interested.

Where do we stand?

  1. You need to talk the talk, you can only make a job redundant, not the person.

    However the government link below is titled:

    Making an employee redundant

    Your formulae should include number of completed years of service, and you can expect 16 not really 8, as the contract would have been 'continuation of service' type, but that is only one element of the figure.

    However obligatory(UK gov.) maximums (not minimums) kick in quiet low really. If you want to offer a better redunancy package that's up to you.
