Question:

We were allowed to have pets before now we're not?

We moved into an apartment 3 years ago the lease said no pets but the manager said we could have them. Over 50% of the people living here have pets. Now since the manager died someone took her place and now she wants to enforce the pet rule. Everyone here got notices today about the pet policy. What do we do?

  1. This happened to me at an apartment I lived at years ago. They had a bad mouse problem so the landlord ok'd cats-although the lease said "no animals". Same situation-new owners came and enforced the lease. Your only option is to adhere or move out-especially since you signed a lease that says "No Pets". However, you can use this time to find a place more accomodating to you and your pets. Sorry those are your two options. I choose to move. Believe it or not, it turned out to be a very good decision. I found another apartment that was much nicer.

  2. You either get rid of any animals or move someplace else with them.

    I do not believe 50% of any neighborhood has animals in their home.

    But, that does not matter, you signed a contract, they do not even have to give you notice since you already knew no animals.    If they change the rule for pets to no pets you are entitled to a 30 day notice.

  3. You look for somewhere more suitable.  I do think it is unfair however that this arrangement will now be rescinded.  It isn't a very practical arrangement and certainly a very upsetting one.  Do you have anything in writing to confirm the position of having a pet?

  4. You're stuck since you do not have a written agreement allowing pets.  when the people were getting pets they should have had pet addendum's added to their lease agreements to make it legal.  Technically anyone with a pet is in violation of their lease and could be evicted.

  6. 50% of the tenants in your building should NEVER have signed a lease that states "no pets"....and then go out and get pets.  

    Unfortunatly, the lease is binding and not following its terms are grounds for termination or eviction.
